1. Who we are and how these terms apply

These Terms of Service (“Terms”) govern access to and use of consulttemplate.com (the “Website”) and the products and services offered under the ConsultTemplate™ name. “ConsultTemplate”, “we”, “us” and “our” refer to ConsultTemplate.com. Contact email: services@consulttemplate.com. Business address: Virtual Office, Ellesmere Port, CH66 1TL.

These Terms apply to website browsing, free resources, the Free Compliance Health Check, digital toolkits and templates, any compliance software or subscription platform made available by us, residential and business assessments, and related consultancy, reporting or support services. Additional product, licence, subscription or assessment terms may apply and form part of the contract where clearly brought to your attention.

By using the Website, placing an order, creating an account or booking a service, you agree to the terms applicable to that activity. If you do not agree, do not use the relevant paid service. Nothing in these Terms limits rights that cannot lawfully be excluded, including applicable consumer rights.

2. Definitions

“Customer” or “you” — the person or organisation using the Website or purchasing or receiving a product or service.

“Digital Materials” — templates, toolkits, policies, procedures, forms, checklists, spreadsheets, guides, frameworks, reports, training resources and other digital content.

“Platform” — any online compliance software, dashboard, workflow, document-management, reminder, reporting or related subscription service offered by ConsultTemplate.

“Assessment” — a residential or business visit, review, audit, diagnostic or evaluation, together with any report or action plan described in the relevant service description.

“Consumer” — an individual acting wholly or mainly outside their trade, business, craft or profession.

“Business Customer” — a customer acting wholly or mainly for business or professional purposes.

3. Our services and information on the Website

The Website may offer, among other things: ISO certification and integrated management system toolkits; QHSE, ESG, sustainability, governance, legal/regulatory, grant/funding, project-management and industry-specific resources; tender and business-excellence packs; a free Compliance Health Check and downloadable resources; the ConsultTemplate Interactive compliance platform; and residential or business assessments such as home safety and well-being, elderly safety, baby-proofing, workplace safety, local visibility and operational efficiency assessments.

Descriptions, screenshots, previews, indicative outcomes and prices are provided to help you understand the offer. They are not a guarantee that a particular outcome will be achieved. Any material limits, deliverables, exclusions, prerequisites, timing and fees for a specific service should be set out on its product page, checkout, booking confirmation or statement of work. If we cannot accept an order, we will tell you and refund any amount paid for it.

We may update Website content to reflect changes in our products, standards, law or business. We will not materially reduce a paid-for service during a fixed term except where reasonably necessary for security, legal compliance, service improvement or circumstances outside our reasonable control; where a change materially disadvantages you, applicable contractual and statutory remedies remain available.

4. Eligibility, accounts and acceptable use

  • You must provide accurate, current information and keep account credentials secure. You are responsible for activity under your account except where caused by our failure to take reasonable security measures.
  • You must not misuse the Website, attempt unauthorised access, introduce malicious code, interfere with service operation, infringe intellectual property, or use the services for unlawful purposes.
  • You must ensure that information and documents you upload or provide may lawfully be shared with us and that you have authority to provide them.
  • We may suspend access proportionately where reasonably necessary to protect security, investigate suspected fraud or misuse, comply with law, or address a material breach. Where appropriate, we will give notice and an opportunity to remedy the issue.
  • You are responsible for the actions of your authorised users and for ensuring that they comply with these Terms and any licence or platform rules.

5. Orders, prices, payment and taxes

Prices and currencies will be shown on the relevant product or service page and at checkout. Unless expressly stated otherwise, the price shown at the point of order is the price applicable to that order. Any applicable VAT, delivery charge, subscription renewal, licence scope or additional fee should be disclosed before you commit to purchase. We may correct obvious pricing errors before accepting an order; if payment has already been taken for an order we cannot honour, we will refund it.

Payment must be made using the methods presented at checkout or otherwise agreed in writing. Payment processing may be provided by third-party payment providers under their own terms and privacy notices. We do not intend to store full payment-card details on our own systems.

An order is accepted when we send an order confirmation or otherwise clearly confirm acceptance. Automated acknowledgement of an order does not necessarily mean that the order has been accepted. You should check order details and contact us promptly if you notice an error.

6. Digital toolkits, templates and licence terms

Digital Materials are licensed, not sold. Your permitted use is determined by the Digital Toolkit Licence Agreement, the licence type selected, the product description and any written product-specific terms. The separate Digital Toolkit Licence Agreement takes precedence for issues relating specifically to toolkit licensing.

  • Unless your licence expressly permits it, you must not resell, sublicense, publish, redistribute, share outside the permitted user group, upload publicly, or make the original Digital Materials available to third parties.
  • Where permitted by your licence, you may adapt materials for your own organisation or create client-specific deliverables. You do not acquire ownership of our underlying templates, structures, methods or other intellectual property.
  • You must review, adapt and validate materials before use, including ensuring that they reflect your actual activities, risks, locations, legal duties and current standards.
  • Downloads and access links may be subject to reasonable security controls, usage limits and licence verification.
  • If a download is defective or materially fails to match its description, contact us so we can investigate and provide an appropriate remedy in accordance with applicable law.

7. Platform subscriptions and software services

Where the Platform is available, the relevant plan page, order confirmation or subscription agreement will identify the features, user limits, price, billing period, renewal and cancellation process. If a subscription automatically renews, this must be clearly disclosed before purchase. You may cancel future renewal using the stated account process or by contacting us; cancellation generally takes effect at the end of the current paid billing period unless the applicable terms or law provide otherwise.

Platform features may include compliance dashboards, guided audit workflows, reminders, document storage, version control, reporting, analytics and multi-user access. Availability and functionality may depend on your plan, configuration, internet access and third-party services. We will take reasonable steps to maintain the Platform, but do not guarantee uninterrupted or error-free availability. We may perform maintenance and security updates.

You remain responsible for the accuracy, completeness and suitability of information entered into the Platform, maintaining appropriate backups of critical records, managing user permissions, and deciding what actions to take based on alerts or reports. Unless separately agreed in writing, the Platform is not an emergency service, a substitute for competent professional judgement, or a guarantee that every legal obligation or deadline will be identified.

8. Free Compliance Health Check and free resources

Free checks, checklists, downloads and recommendation engines are provided for general information and preliminary self-assessment. Their outputs depend on the answers and information you provide and the logic, sources and version in use at the time. They are not a formal audit, legal opinion, certification decision, exhaustive legal register or assurance that your organisation complies with every applicable requirement.

Where you provide an email address to receive a requested resource, we may use it to deliver that resource and administer the request. Marketing emails will be sent only where we have a lawful basis and comply with applicable direct-marketing rules. You can unsubscribe from marketing messages at any time; service and transaction messages may still be sent where necessary.

9. Assessments, visits and reports

Assessment scope, price, location, access requirements, deliverables, exclusions and estimated timescales will be stated in the service description, booking confirmation or written proposal. If the service requires access to a home, workplace, premises, systems or records, you must arrange safe and lawful access and provide accurate information relevant to the assessment.

  • You must tell us in advance about known access restrictions, relevant hazards, safeguarding considerations or other conditions that may affect safe delivery.
  • We may reschedule or stop a visit if conditions are unsafe, access is unavailable, information is materially incomplete, or circumstances outside our reasonable control prevent delivery. We will discuss reasonable alternatives and any applicable refund or rescheduling rights.
  • Reports and action plans reflect the scope, information and conditions observed at the time. Unless expressly agreed, they are not structural surveys, medical assessments, legal opinions, statutory inspections, certification decisions or guarantees that all hazards or deficiencies have been identified.
  • You remain responsible for deciding and implementing remedial actions, complying with legal duties, obtaining specialist advice and addressing immediate danger. If an immediate serious risk is observed, we may advise you to take urgent protective action or contact the relevant emergency or competent authority.
  • Local visibility and operational efficiency assessments are diagnostic services. Search rankings, leads, sales, savings, productivity improvements and other commercial outcomes depend on factors outside our control and are not guaranteed.

10. Consumer cancellation, refunds and digital content

If you are a Consumer, you may have statutory cancellation rights for distance contracts, commonly including a 14-day cancellation period for services and digital content, subject to the applicable legal rules and exceptions. We will provide any legally required pre-contract information and cancellation instructions for the relevant order.

For digital content supplied electronically during a statutory cancellation period, we will not rely on an exception to the cancellation right unless the required express consent and acknowledgement have been obtained and the other legal conditions are met. Where required, checkout will include a separate, unticked consent mechanism acknowledging that immediate supply may result in loss of the cancellation right for that digital content.

For services, if you ask us to begin work during the cancellation period, we will obtain any legally required express request and explain any payment that may be due if you cancel after performance has begun. If a service is fully performed during that period, any loss of the cancellation right will only apply where the legal requirements are met.

Nothing in these Terms removes your statutory rights if digital content, goods or services are faulty, not as described, not supplied with reasonable care and skill, or otherwise fail to meet mandatory legal requirements. Refunds and remedies will be assessed in accordance with the applicable contract and law. Business Customers should refer to their order-specific terms.

11. Professional, regulatory and outcome disclaimer

Unless a separate written agreement expressly says otherwise, our templates, toolkits, assessments, reports, software and recommendations are informational and practical support tools. They do not themselves constitute legal advice, statutory approval, certification, accreditation, professional assurance, engineering sign-off, medical advice or a guarantee of compliance.

Standards, laws and guidance may change and may be interpreted differently according to sector, jurisdiction and circumstances. You are responsible for checking current requirements, determining which apply to you, obtaining independent professional advice where appropriate, and implementing controls that reflect your actual risks and operations. Purchasing or using our materials does not guarantee ISO certification, a successful audit, a tender award, a particular search position or any other outcome.

12. Intellectual property

The Website and its original content, branding, design, databases, software, methodologies and Digital Materials are owned by us or our licensors and are protected by applicable intellectual-property laws. Except for rights expressly granted under a licence or mandatory law, no rights are transferred to you. You may not remove ownership notices or use our name or marks in a way that suggests endorsement without written permission.

The Website may link to or integrate with third-party websites, payment processors, hosting providers, analytics tools, email services, maps, search platforms or other services. Those services may be governed by their own terms and privacy notices. We are not responsible for third-party services that we do not control, but this does not affect any responsibility imposed on us by law.

14. Privacy and security

Our handling of personal data is described in the ConsultTemplate Privacy Policy. You should read it alongside these Terms. If you upload personal data about employees, household members, customers or other people into the Platform or provide it during an assessment, you must have authority to do so and provide any required privacy information. Where the Platform processes personal data on your behalf, a separate data processing agreement may be required.

15. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any mandatory consumer rights.

To the extent permitted by law, we are not responsible for losses caused by inaccurate or incomplete information supplied by you, your failure to adapt or implement recommendations, unauthorised changes made to materials, third-party systems outside our control, or use of a product outside its stated purpose. We do not exclude liability where the law does not permit us to do so.

For Business Customers only, and subject to the preceding paragraph, we will not be liable for indirect or consequential loss, loss of profit, revenue, business opportunity, anticipated savings or goodwill. Any financial cap on liability must be expressly agreed in the relevant business contract and remains subject to applicable law; these Terms impose no blanket financial cap.

16. Suspension, termination and changes

You may stop using the Website at any time. Subscription termination, licence expiry and the consequences of termination are governed by the applicable plan and licence terms. We may suspend or terminate access for material breach, unlawful activity, security risks, non-payment or where required by law, acting proportionately and giving notice where appropriate. Termination does not affect accrued rights or obligations or statutory rights.

We may revise these Terms from time to time. The version applicable to a purchase will normally be the version made available when the order was placed. For ongoing subscriptions or services, we will notify you of material changes where reasonably required; if a change materially affects your rights, the notice will explain any available options, subject to law.

17. Complaints, governing law and general provisions

Please send service questions or complaints to the contact email stated in Section 18. We will aim to acknowledge and investigate complaints within a reasonable time. These Terms are governed by the laws of England and Wales, except that Consumers retain any mandatory protections and rights to bring proceedings available under applicable law.

If a provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. These Terms, together with applicable product descriptions, order confirmations, licence terms, subscription terms and written service agreements, form the relevant agreement. Specific written terms prevail over these general Terms to the extent of a genuine conflict, unless mandatory law provides otherwise.
